DISTANCE SALES AGREEMENT

This Distance Sales Agreement (“Agreement”) governs the online purchase of education services provided by Mergen Chess. The Order Summary shown before payment—including the programme, term, class, additional services, total price, discount, payment method and parent/student details—forms an integral part of this Agreement.
Order-specific information is presented before payment. The Agreement is formed electronically when payment is completed. The Agreement and order record are retained for the statutory period and supplied to the consumer on a durable medium upon request.
1. Parties
Service Provider
Buyer / Consumer
The parent or legal guardian whose name, email address, telephone number and billing details appear in the order form. Student details form part of the Order Summary for delivery of the education service.
2. Subject and Legal Basis
The Agreement covers the sale and delivery of the online chess education and related digital services selected by the consumer and the parties’ rights and obligations. Turkish Consumer Protection Law No. 6502, the Distance Contracts Regulation and related Turkish legislation apply.
3. Main Characteristics of the Service
The purchased service consists of the Academy programme, coaching and match-analysis add-on, opening or endgame camp, summer school or private-lesson package selected in the Order Summary. The lesson count, term, level, class, dates and add-ons are displayed before payment.
Live lessons are delivered online. Student-portal access, lesson links, homework, videos and progress tools are provided according to the selected programme.
4. Application and Formation
The process begins with an application. An accepted applicant receives a personal registration link, selects available services, reviews the Order Summary and total price, completes required information and proceeds to secure payment. Enrolment is final when payment is verified.
5. Price, Payment and Invoice
- The total in the Order Summary includes VAT and shows any discount or coupon.
- Payment is made by debit or credit card through iyzico. Instalment options depend on the card issuer and payment provider.
- Season enrolment charges the season total shown in the Order Summary.
- Monthly Academy enrolment charges only the first month online; later months are billed separately and the card is not automatically charged.
- Corporate invoices require the company name, tax office, tax number and billing address before payment.
6. Performance of the Service
The service is delivered online on the dates stated in the Order Summary or programme timetable. A level, class-placement or introductory meeting may be arranged after payment; portal access and lesson details are supplied after enrolment is completed.
If a scheduled lesson cannot take place because of force majeure, an instructor’s unavoidable absence or a technical issue attributable to Mergen Chess, a make-up lesson, recording or equivalent solution will be provided within a reasonable period.
7. Consumer Obligations
- Provide accurate parent, student and billing information
- Attend lessons on time with a suitable device and internet connection
- Keep account, registration and lesson links private
- Use educational materials only for the student’s personal education
- Respect other students’ rights and child-safety rules
8. Right of Withdrawal
The consumer has 14 days from formation of a service contract to withdraw without giving a reason or paying a penalty. Notice must be sent in writing or on a durable medium within that period; telephone notice alone is insufficient.
Statutory exceptions may apply to services begun before the end of the withdrawal period at the consumer’s express request and approval, services performed instantly online, and digital content supplied instantly. An exception applies only where the consumer received the required pre-contract information and separately gave the approval required by law.
9. Refunds
Following a valid withdrawal notice, payments are refunded within the statutory period and no later than 14 days, using a method compatible with the original payment instrument and without cost to the consumer. The time taken by the bank or card issuer to post the refund is outside Mergen Chess’s control.
Cancellation, programme change or enrolment-freeze requests outside the statutory right of withdrawal are assessed under the announced programme conditions, the portion already performed and mandatory consumer law.
10. Lesson Recordings and Personal Data
Personal data is processed under the Privacy Notice and Privacy Policy. Separate consent is obtained where required for lesson recordings or sharing recordings within a class. Payment, video-conferencing and cloud providers participate only as necessary to deliver the service.
11. Intellectual Property
Educational materials, videos, homework, analyses and software features belong to Mergen Chess or the relevant rights holder. A purchase grants only a personal, non-transferable right of use.
12. Force Majeure
Natural disasters, epidemics, widespread internet or power failures, public-authority decisions, war, strikes and comparable events beyond reasonable control may postpone obligations to the extent affected. The parties will make reasonable efforts to continue or make up the service.
13. Complaints and Disputes
Consumers may first contact Mergen Chess below. Unresolved disputes may be brought before the competent Turkish Consumer Arbitration Committee or Consumer Court under current monetary thresholds and jurisdiction rules. Mandatory mediation rules remain reserved.
14. Entry into Force
The consumer confirms having had an opportunity to review the Order Summary and Agreement before payment and understands that completing payment creates a payment obligation. Any term conflicting with mandatory law is not applied; the remaining terms continue in effect.
