TERMS OF USE

These Terms of Use govern the Mergen Chess website, mobile application, student portal and related digital education services. By using the website or app, applying to a programme or receiving a service, the user confirms that they have read and accepted these terms.

Services intended for children must be used under the supervision of a parent or legal guardian. The adult completing registration and payment confirms that they have authority to act for the student.

1. Scope of Services

  • Live online group classes and one-to-one lessons
  • Homework, videos, lesson recordings, progress tracking and analysis tools
  • One-to-one coaching and tournament-game analysis
  • Seasonal opening and endgame camps and summer school programmes
  • Timetables, notifications, appointments and student-portal services

The scope, duration, schedule, level and price of a programme are defined by the programme page, acceptance letter and order summary presented before payment.

2. Application and Enrolment

Enrolment follows an application and assessment process. If an application is accepted, the parent receives a personal registration link through which available programmes, lesson groups and additional services can be selected.

Submitting an application does not by itself guarantee admission or a place in a particular class. Enrolment becomes final after payment has been verified and the required student information has been completed.

3. Account and Security

  • Users must keep their registration and profile information accurate and current.
  • Account credentials, lesson links and personal registration links may not be shared with third parties.
  • Mergen Chess must be notified promptly of suspected unauthorised account use.
  • Accounts that compromise security, attempt unauthorised access or misuse the service may be restricted temporarily or permanently.

4. Attendance and Technical Requirements

Online participation requires a reliable internet connection and a device capable of transmitting audio and video. Mergen Chess is not responsible for interruptions caused by a user’s device or connection. Where an interruption is attributable to Mergen Chess, a make-up lesson, recording or equivalent solution may be offered according to the programme.

Schedules are published in Türkiye time. One-to-one scheduling, class changes, absences and make-up arrangements are governed by the rules announced for the relevant programme.

5. Fees and Payment

  • Prices shown before payment include VAT; applicable discounts and coupons appear in the order summary.
  • Card payments are processed securely by iyzico. Mergen Chess does not store card details.
  • Season enrolment charges the full season total shown in the order summary; instalment options offered by the bank may appear on the payment page.
  • Monthly Academy enrolment charges only the first month online. Later months are invoiced separately by Mergen Chess and this is not an automatically renewing card subscription.
  • Currency, payment method and instalment availability for international payments are governed by the order summary.

6. Intellectual Property and Content Use

Lesson videos, analyses, homework, presentations, software, designs and other educational materials belong to Mergen Chess or the relevant rights holder. They are licensed only for the registered student’s personal education and may not be copied, published, sold, shared with another account or used commercially without permission.

7. Conduct

Users must act respectfully in classes, messaging areas and community features and must not engage in abuse, threats, discrimination, harassment, cheating, spam or unlawful activity. Content may be removed and access restricted where conduct endangers children or the rights of others.

8. Lesson Recordings and Personal Data

Lesson recordings, sharing recordings within the same class and processing personal data are governed by the Privacy Notice, Privacy Policy and, where required, separate explicit consent. Receiving the notice and granting consent are separate processes.

9. Third-Party Services

Use of services such as Zoom, Lichess, Firebase and iyzico may also be subject to their own terms. Mergen Chess will make reasonable efforts to resolve issues but cannot guarantee uninterrupted operation of third-party systems outside its control.

10. Changes, Suspension and Termination

Mergen Chess may improve its services, make reasonable timetable changes or temporarily suspend a feature for technical reasons. Access may be suspended or terminated for a serious breach of these terms. Mandatory consumer rights remain unaffected.

11. Governing Law and Contact

Turkish law governs these terms. Consumers may apply to the competent Consumer Arbitration Committee or Consumer Court under the monetary limits and jurisdiction rules in force. Mandatory mediation rules remain reserved.
